Welcome to FitnessMap (“we,” “our,” or “us”). By accessing or using fitnessmap.net (the “Site”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Site.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms.

2. Eligibility

You must be at least 18 years old to use FitnessMap. By using the Site, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account Registration

3.1 Account Creation

To access certain features of the Site, you must create an account. You agree to:

• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason we deem appropriate. You may also delete your account at any time through your account dashboard.

4. Listing Services

4.1 Listing Types

FitnessMap allows users to create listings for:

• Gyms and fitness centers (Clubs & Centers)
• Personal trainers and fitness coaches (Coaches & Specialists)
• Fitness events and classes (Events)

4.2 Listing Content

You are solely responsible for the content of your listings, including text, images, videos, pricing, and contact information. You represent and warrant that:

• You have the right to publish all content in your listing
• Your listing content is accurate, current, and not misleading
• Your listing does not violate any laws or third-party rights
• You hold valid certifications, licenses, and insurance as required by law

4.3 Listing Review

We reserve the right to review, approve, reject, or remove any listing at our sole discretion. We are not responsible for verifying the accuracy of listing information or the qualifications of listed businesses or trainers.

5. Listing Packages & Payments

5.1 Pricing

FitnessMap offers various listing packages with different features and durations. Prices are displayed on the Site and are subject to change at any time. Current users will be notified of price changes that affect their active packages.

5.2 Payment Methods

We accept payments through:

• Whish Money Lebanon (primary payment method)

5.3 Payment Terms

• Payments are due immediately upon purchase
• All prices are in USD as displayed
• You are responsible for any applicable taxes
• Package activation begins immediately after payment confirmation

5.4 Refund Policy

All listing package purchases are final. We do not offer refunds except in the following circumstances:

• Technical error preventing listing activation (within 7 days of purchase)
• Duplicate charges or billing errors
• Site unavailability for more than 72 consecutive hours

To request a refund, contact us at fitnessmapofficial@gmail.com within 7 days of purchase with your order details.

5.5 Package Duration & Renewal

Listing packages are valid for the duration specified at the time of purchase (e.g., 30 days, 90 days, 1 year). Packages do not auto-renew at this time. We may introduce automatic renewal in the future, with prior notice to users. You will receive a notification before your package expires with renewal options.

6. User-Generated Content

6.1 Reviews & Comments

Users may post reviews and comments about listings. By posting content, you grant FitnessMap a perpetual, worldwide, royalty-free license to use, display, and distribute your content on the Site. You agree that your reviews and comments will:

• Be based on your genuine experience
• Not contain false or misleading information
• Not include offensive, abusive, or discriminatory language
• Not violate any laws or third-party rights

6.2 Content Moderation

We reserve the right to remove any user-generated content that violates these Terms or is otherwise objectionable. We are not obligated to monitor all user content but may do so at our discretion.

7. Prohibited Activities

You agree not to:

• Create fake or fraudulent listings
• Impersonate any person or entity
• Post false, misleading, or deceptive content
• Spam, harass, or abuse other users
• Scrape, copy, or extract data from the Site
• Use automated tools or bots to access the Site
• Attempt to bypass security measures or access restricted areas
• Violate any applicable laws or regulations
• Infringe on intellectual property rights

8. Intellectual Property

8.1 Site Content

All content on FitnessMap, including text, graphics, logos, design, software, and functionality, is owned by FitnessMap or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2 User Content

You retain ownership of content you upload to the Site. However, by uploading content, you grant FitnessMap a license to use, display, and distribute that content in connection with operating the Site.

9. Disclaimer of Warranties

The Site is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that:

• The Site will be uninterrupted, secure, or error-free
• Listing information is accurate, complete, or current
• Any defects or errors will be corrected

FitnessMap is a directory platform. We do not employ trainers, specialists, or operate gyms. We are not responsible for the quality, safety, or legality of services provided by listed businesses. Use of any fitness service found through FitnessMap is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, FitnessMap shall not be liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage arising from use of listed services
• Actions or omissions of listed businesses, trainers, or other users
• Unauthorized access to or alteration of your data

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless FitnessMap, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Site
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you post or upload

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Lebanon. Any disputes shall be resolved in the courts of Beirut, Lebanon.

12.2 Informal Resolution

Before pursuing formal legal action, you agree to contact us at fitnessmapofficial@gmail.com to attempt to resolve the dispute informally.

13. Third-Party Services

We are not responsible for the practices, content, or services of third parties. Your use of third-party services is governed by their own terms and policies.

14. Relationship Between Parties

FitnessMap is a directory platform. We do not:

• Employ or control listed businesses or trainers
• Act as an agent or representative of listed businesses
• Guarantee the quality, safety, or legality of listed services
• Mediate disputes between users and listed businesses

Any transactions, bookings, or agreements made through the Site are directly between you and the listed business. We are not a party to those transactions.

15. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Site will immediately cease
• Your listings will be removed
• Unused portions of paid packages are non-refundable
• Sections that by their nature should survive termination will remain in effect

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitnessMap.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.
